ZHR Digital (“ZHR Digital,” “we,” “us,” or “our”) is a digital marketing and creative agency with offices in Toronto, Ontario, Canada, and Dhaka, Bangladesh. We respect your privacy. This Privacy Policy explains what personal information we collect through zhrdigital.com (the “Website”) and in the course of providing our services, how we use and share it, how long we keep it, and the choices and rights you have.

This policy should be read with our Cookie Policy and Terms and Conditions.

Who is responsible for your information

ZHR Digital is responsible for the personal information it collects and uses. Our Privacy Officer oversees our privacy practices and can be reached at in**@********al.com or at ZHR Digital, 930 Midland Ave, Scarborough, Ontario M1K 4G3, Canada.

Information we collect

Information you give us. When you use the contact, quote, consultation, audit, or subscription forms, book a call, message us, or become a client, you may give us:

  • your name, email address, phone or WhatsApp number, company name, job title, and website address;
  • the subject and content of your message, your goals, budget, and monthly advertising spend;
  • files you upload with a quote request;
  • billing details and payment information needed to invoice you, which are handled through payment processors;
  • information you give us when you reply to our emails, take part in a survey, or contact us in any other way.

Information collected automatically. When you visit the Website, we and our service providers may collect your IP address, browser and device type, pages viewed, time and date of visit, referring website, and similar usage data, using cookies and similar technologies. See our Cookie Policy for details and your choices.

Information from client accounts and tools. If you are a client, we may receive access to your website, advertising, analytics, and social media accounts, and to the data in them, so that we can provide the services. We use that data only for your engagement.

Information from other sources. We may receive information from publicly available sources, business directories, and platforms such as LinkedIn when we respond to or follow up on a business enquiry.

How we use your information

  • To respond to you. When you submit a form or contact us, we use your information to reply to your request, prepare a quote, schedule a consultation, or run an audit.
  • To provide our services. We use it to carry out, manage, and report on the services you hire us for, and to invoice and collect payment.
  • To send marketing. With your consent, we send newsletters, news, and offers. You can unsubscribe at any time.
  • To run and improve the Website. We use usage data to understand how the Website is used, fix problems, keep it secure, and improve it.
  • To measure and improve our advertising, where you have agreed to the relevant cookies.
  • To protect our business and users, including preventing spam, fraud, and misuse.
  • To meet legal obligations, such as tax, accounting, and law enforcement requests.

Consent and legal basis

When you submit a form on the Website, you are asking us to contact you, and we rely on that request to reply to you about it. We ask for your separate consent before sending marketing emails and before using non-essential cookies, where the law requires it. You can withdraw your consent at any time.

If you are in the European Union, the United Kingdom, or another place where a legal basis is required, we process your information based on your consent, to carry out a contract or take steps you ask for before a contract, for our legitimate interests in running and promoting our business (balanced against your rights), and to meet legal obligations.

Marketing emails

We send marketing messages only with your consent or where the law otherwise allows it. Every marketing message identifies us and includes a way to unsubscribe, and we act on unsubscribe requests promptly and within 10 business days. Unsubscribing from marketing does not stop service messages related to an existing engagement.

How we share your information

We do not sell your personal information. We share it only as follows:

  • Service providers. We use trusted providers to help us run the Website and our business. These include website hosting and WordPress services (including Automattic and Jetpack), Google (including Analytics, Tag Manager, Ads, Workspace, Sheets, and Drive, which we use to store and organize form submissions and documents), Meta (where we use advertising measurement), Calendly (online booking), OptinMonster (popups), CleanTalk (anti-spam), WhatsApp and email providers (communication), and payment processors. They may use your information only to provide services to us and under their own legal obligations.
  • Advertising platforms. Where you agree to marketing cookies, certain data may be shared with advertising platforms to measure and improve ads.
  • Professional advisers such as accountants, lawyers, and insurers, where needed.
  • Legal and safety reasons. We may disclose information when required by law, a court order, or a valid legal request, or to protect our rights, property, or safety.
  • Business transfers. If we merge with, are acquired by, or sell part of our business, information may be transferred as part of that transaction, subject to this policy.

Where your information is stored and processed

We operate in Canada and Bangladesh, and many of our service providers, including Google and Meta, process information in other countries, including the United States. Your information may be stored or accessed in countries whose privacy laws differ from those where you live, and may be available to courts or authorities in those countries under their laws. We take steps, including contracts and security measures, to protect your information when it is handled by others or transferred across borders.

How long we keep your information

  • Enquiries that do not lead to an engagement: generally up to 24 months after our last contact.
  • Client records and invoices: for the length of the engagement and generally up to 7 years afterwards, to meet tax and accounting requirements.
  • Marketing subscriber details: until you unsubscribe, after which we keep a minimal record so that we do not contact you again.
  • Website usage data and cookies: for the periods described in our Cookie Policy.

When we no longer need information, we delete it or anonymize it, unless the law requires us to keep it.

Security

We use reasonable physical, technical, and organizational safeguards to protect personal information, including access controls and the security tools of our providers. No method of transmission or storage is completely secure, so we cannot guarantee absolute security. If a breach creates a real risk of significant harm to you, we will notify you and the relevant authorities as the law requires.

Your rights and choices

Depending on where you live, you may have the right to:

  • ask for access to the personal information we hold about you;
  • ask us to correct information that is inaccurate or incomplete;
  • ask us to delete your information, subject to legal requirements;
  • withdraw your consent, including to marketing emails and non-essential cookies;
  • object to or ask us to restrict certain uses of your information;
  • receive a copy of the information you gave us in a portable format; and
  • make a complaint to a privacy regulator.

To use any of these rights, email in**@********al.com. We may need to confirm your identity first. We aim to respond within 30 days.

If you are not satisfied with our response, you can contact the Office of the Privacy Commissioner of Canada. If you are in the European Union or the United Kingdom, you can contact your local data protection authority.

Children

The Website and our services are intended for businesses and adults. We do not knowingly collect personal information from children. If you believe a child has given us personal information, please contact us and we will delete it.

Third-party websites

The Website may link to or embed third-party websites and tools. We are not responsible for their privacy practices, so please read their policies.

Changes to this policy

We may update this Privacy Policy from time to time, for example when we add tools or change how we handle information. The “Last updated” date above shows when it was last revised. If we make a significant change, we will take reasonable steps to tell you, for example by a notice on the Website.
